Revocable License Agreement
(Temporary Swing Housing – No Tenancy Created)
This Revocable License Agreement (“Agreement”) is made as of [Date], by and between:
- Licensor (Property Owner/Manager): [Name, Address]
- Licensee (Relocating Landlord/Entity): [Name, Address]
- Occupant (Displaced Tenant): [Name(s)]
Collectively referred to as the “Parties.”
1. Grant of License
Licensor grants Licensee and Occupant a limited, temporary, non-transferable, and revocable license to use the premises located at:
Property Address: [Insert Address] (“Premises”)
This license is granted solely for the purpose of providing temporary swing housing during Tenant Habitability Program (THP) construction or repair work.
2. No Tenancy or Lease
- This Agreement does not create a lease, sublease, or tenancy of any kind.
- Occupant acknowledges and agrees that no landlord-tenant relationship exists between Licensor and Occupant.
- Occupant acquires no right of possession, tenancy, or continued occupancy beyond the license period.
- Occupant waives any claim to tenancy rights, rent control protections, or “just cause” eviction rights with respect to the Premises.
3. Term

- The license automatically terminates at the End Date unless revoked earlier under Section 4.
4. Revocability
- This license is revocable at will by Licensor with [X] days’ written notice.
- Upon revocation or expiration, Occupant must vacate immediately and return possession of the Premises in good condition.
- If Occupant fails to vacate, Licensee and Licensor may pursue licensee holdover remedies (not unlawful detainer as a tenant).
5. Use Restrictions
Occupant agrees to:
- Use the Premises solely for residential relocation purposes.
- Not assign, sub-license, or allow others to occupy without Licensor’s consent.
- Comply with all laws, HOA rules (if applicable), and building regulations.
- Maintain the Premises in good order, with reasonable wear and tear excepted.
6. Payments
- Licensee shall pay Licensor a total license fee of $[Amount] (insert Fair Market Rent Amount) per month for the duration of this Agreement.
- Payments are made through the Swing Unit Marketplace platform (escrow-style).
- This fee is expressly a license fee, not rent, and shall not be construed as creating a tenancy.
7. Insurance & Liability
- Occupant and/or Licensee are responsible for obtaining any and all insurance including but not limited to renter's, fire, earthquake, and liability insurance.
- Licensor shall not be liable for loss, damage, or injury except as required by law.
- Swing unit Licensor shall not be liable for loss, damage, or injury except as required by law.
- Swing Unit provides only a platform to facilitate temporary license agreements between property owners and occupants. Swing Unit is not a landlord, property manager, or housing provider, and assumes no responsibility for any actions, omissions, damages, or disputes arising from or related to an occupant's use of a property. This includes, without limitation: (i) damage to property caused by occupants; (ii) claims, rights, or protections asserted under tenant or housing laws; (iii) any eviction or removal proceedings; and (iv) any other occupant-related issues, disputes, or liabilities. All responsibilities for compliance with applicable laws, tenant habitability obligations, and enforcement of agreements rest solely with the property owner(s) and occupant(s). Swing Unit shall not be liable for any direct, indirect, incidental, or consequential damages arising from occupant use.
8. Compliance with THP
- This Agreement is intended solely for temporary relocation housing under the Tenant Habitability Program (THP).
- Licensee (the relocating landlord) remains responsible for compliance with all THP obligations to the displaced tenant.
9. Surrender of Premises
On expiration or revocation, Occupant must:
- Vacate the Premises,
- Remove all personal belongings,
- Return keys/fobs to Licensor,
- Leave the Premises in substantially the same condition as delivered.
Failure to vacate may result in immediate removal without the protections of tenancy laws.
10. Entire Agreement
This document represents the entire agreement between the Parties regarding temporary occupancy of the Premises. No oral promises, implied terms, or landlord-tenant laws shall apply.
